End User License Agreement (EULA) & Terms of Service

This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "You") and Cosmix ("Company," "We," or "Us"). By downloading, installing, or using the Cosmix mobile application ("App"), you agree to be bound by the terms of this Agreement.

1. Acceptance of Terms​

By creating an account and accessing the App, you verify that you are at least 18 years of age and capable of entering into a binding contract. If you do not agree to these terms, do not use the App.

2. Description of Service​

Cosmix is a social discovery platform that utilizes astrological data to analyze compatibility and suggest potential romantic matches. The App generates charts and compatibility scores based on the specific birth data provided by the User.

3. Data Collection and Privacy​

We take your privacy seriously. By using Cosmix, you consent to the collection and processing of specific Personally Identifiable Information (PII) under the following strict conditions:

3.1 Information Collected​

To function, the App requires the following data points:

  • Full Name
  • Date of Birth
  • Precise Time of Birth (required for Ascendant and House calculation)
  • Location of Birth (City/Country/Coordinates)
  • Gender Identity
  • Sexual Preference

3.2 Purpose of Use​

This information is used solely for the purpose of:

  • Calculating your natal chart and astrological profile.
  • Comparing your profile against other users to generate compatibility matches ("Synastry").
  • Displaying your astrological profile (e.g., Sun, Moon, Rising signs) to potential matches, as authorized by your profile settings.

3.3 Data Protection & Non-Sharing Clause​

Cosmix Studios strictly covenants that your PII (specifically birth time and birth location coordinates) will not be sold, rented, leased, or shared with third-party advertisers or data brokers. Your data is used exclusively for internal matching algorithms within the Cosmix ecosystem.

4. User Conduct​

You agree not to use the App to:

  • Harass, stalk, defame, or intimidate other users.
  • Impersonate any person or entity or misrepresent your birth data to deceive others.
  • Scrape, mine, or use automated systems to extract data from the App.

5. User-Generated Content (UGC) Policy​

Cosmix allows users to upload profile photos and send messages ("User-Generated Content" or "UGC"). To ensure a safe environment:

  • Zero Tolerance: We maintain a zero-tolerance policy for objectionable content, including but not limited to abusive, defamatory, explicit, or discriminatory material.
  • Reporting and Blocking: You may report inappropriate UGC or block other users directly within the App.
  • Moderation: We reserve the right to review, remove, or delete any UGC that violates these terms. We will act on reported content within 24 hours. Users found violating these policies will be permanently banned from the App.

6. Intellectual Property​

The App, including its source code, astrological algorithms, logo, and design, is the proprietary property of Cosmix Studios. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.

7. Subscriptions, Renewals, and Payments​

7.1 Subscription Tiers​

The App may offer various subscription tiers ("Insight," "Connection," "Cosmic Coach") and consumable in-app purchases ("Add-ons"). Features available depend on the selected tier.

7.2 Billing​

All payments for subscriptions and Add-ons are processed through the Apple App Store or Google Play Store ("App Store") and are subject to their terms and conditions. Payment will be charged to your App Store account at confirmation of purchase.

7.3 Automatic Renewal​

Subscriptions automatically renew for the same duration and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

7.4 Cancellation​

You may manage or cancel your subscription at any time by going to your account settings in the App Store after purchase. Deleting your Cosmix account or the App does not automatically cancel your subscription.

7.5 Refunds​

All purchases are final and non-refundable. Any refund requests are subject to the refund policies of the App Store (Apple or Google) and are not managed by the Company.

7.6 Price Changes​

We reserve the right to change subscription prices. We will provide you with reasonable notice of any price changes by posting the new prices on or through the app and/or by sending you an email notification.

8. Disclaimer of Warranties (The "For Entertainment Purposes" Clause)​

8.1 No Guarantee of Match​

Cosmix provides compatibility suggestions based on astrological theory. We make no guarantees regarding the accuracy of astrological predictions, the success of any match, or the conduct of any user you meet.

8.2 Entertainment Only​

The astrological insights provided are for entertainment and social discovery purposes only. They do not constitute psychological, legal, or medical advice.

9. AI-Generated Content​

Some features of the App utilize Artificial Intelligence (AI) to generate personalized astrological insights, synthesized compatibility reports, and relationship advice. By using the App, you acknowledge and agree that:

  • AI systems are automated and can sometimes produce inaccurate, unpredictable, or nonsensical responses.
  • All AI-generated content is provided strictly for entertainment purposes and should not be relied upon for making significant personal, medical, financial, or legal decisions.
  • Company is not liable for any actions taken based on AI-generated advice or insights.

10. Limitation of Liability​

To the fullest extent permitted by law, Cosmix Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) Your access to or use of or inability to access or use the App; (b) The conduct or content of any third party or other user on the App.

11. Termination​

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties, or for any other reason.

12. Governing Law​

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
